www.MyOperaPlayer.com is an audiovisual communication website owned by FUNDACIÓN DEL TEATRO REAL, which allows users to play promotional audiovisual contents from Teatro Real productions and other contents, without restriction. Furthermore, full works from the Video Library and online live broadcasts from Teatro Real may be played by subscribing to gain access to the corresponding services.

 

Please read the legal terms and conditions you will find below. These conditions regulate access, browsing and use of the My Opera Player website from Fundación Pública Teatro Real FSP (hereinafter, the Foundation) located in the URL: www.myoperaplayer.com (hereinafter, the Website).

 

Access, browsing and use of this Website implies your express and unreserved acceptance of all the terms found in this Legal Notice, with the same validity and efficacy than any contract held in writing and signed to that purpose.

Access to and use of MOP requires an Internet connection and a device compatible with MOP.

 

Access to the catalogue of services provided in MOP is free of charge. However, access to the services and contents offered through the Website are subject to registration and to the prior hiring and payment of the corresponding fees.

 

Access to the Website by minors is prohibited, except if they have prior express authorisation from their parents or legal guardians, who will be considered to be responsible for any activities carried out by the child in their care, in accordance with current regulations. In any case, access to the Website carried out by a child will be understood to be carried out with the prior and express authorisation of their parents or legal guardians. Access to and browsing of the Website does not require registration.

 

Access to and browsing of the Website does not require registration. However, access to viewing, using and/or hiring certain products and/or services may require the user to first register on the Website choosing a user name and password.

 

The password, which is personal and cannot be transferred, must be generated by the User pursuant to the robustness and complexity rules established by MOP at any given time. The password created by the User will be valid for a limited time period. If the User sets up a password that does not comply with the minimum requirements, the User will be notified of this and of the conditions that the password must meet for registration of the interested party into the Foundation Users Registry to be valid.

 

Nevertheless, the Website has the necessary functionalities in place for a User to change their password whenever required; for instance, if they suspect or verify that their password confidentiality has been broken. Passwords are personal and cannot be transferred. Users commit to making a diligent use of their password and to keep it to themselves, not communicating it to a third party or to the Foundation itself. As a result, Users are in charge of the suitable safekeeping and confidentiality of any user identification and/or passwords selected by them to register on MOP and commit to not ceding their use to third parties on a temporary or permanent basis, or to allow access to other people.

 

Users will be liable for any wrongful use of the Website by any non-authorised third party using to this end a password obtained through non-diligent use or loss by the User.

 

By virtue of the above, Users are obliged to notify the Website’s administrators immediately about any event that could allow the wrongful use of the user’s identification and/or password, such as theft, loss or unauthorised access thereto, for the purposes of cancelling them immediately. Until such events are not communicated, the Foundation will not be liable for any events derived from the wrongful use of a user’s identification or password by unauthorised third parties.

Service responsibilities and guarantees


The Foundation makes every effort to guarantee the reliability, usefulness or veracity of the services or any information provided through the  website. Nevertheless, occasionally, the Foundation may be unable to guarantee at all moments any aspects quoted earlier and will not be held liable for them. However, the Foundation states that it has adopted all necessary measures, within its capabilities and given the state of technology, to guarantee the functioning of the Website and to avoid the existence and transmission of viruses and other harmful components to Users.

 

The Foundation will not be held liable for service interruptions, delays, errors or the malfunctioning thereof, and, in general, any other  inconveniences that originate in reasons out of its control and/or from the User’s wilful or negligent activity, and/or those caused by force majeure. Without prejudice to Article 1.105 of the Civil Code, any events taking place that escape the Foundation’s control will be understood to fall within the concept of force majeure for the purposes of these terms and conditions, as for instance: failure from third parties, service operators or companies, Government actions, lack in access to third-party networks, acts or omissions from the public authorities, those arising from natural disasters,
blackouts, etc., and an attack from hackers or third parties specialising in the safety and integrity of the computing system, as long as the Foundation has adopted all security measures available according to the state of technology.

 

The Foundation will be entitled to temporarily suspend the Website’s services and Contents to carry out maintenance, improvement or repair thereof, without any compensation due to the User for such concepts. If any such interruption is definite, availability of the information stored in the different services cannot be guaranteed. However, any such circumstance will be notified to Users beforehand. Without prejudice to the above, regardless of the cause, the Foundation will not be held liable for any loss of information, for direct or indirect damages, emerging damages and/or lost profits. 

 

The Foundation will not be liable for the use that a User makes of the Website’s services and products or for their passwords, as well as of any other Website material that infringes upon third-party intellectual or industrial property rights or any other rights. If adult Content should exist, it will be the responsibility of the User or of their legal guardians, to limit access to the children of whom they are in charge, through mechanisms made available to them by the Internet browser or other third-party services. 

 

If a User becomes aware of the existence of any illegal content that goes against the law or that could be an infringement of intellectual and/or industrial property rights, they must notify the Foundation immediately so that suitable measures can be adopted. Users will be liable for any damages the Foundation may undergo as a result of non- compliance with any of the obligations to which they are subject pursuant to these conditions or any applicable particular conditions.

 

Intellectual and Industrial Property Rights. Ownership of the content


All brands, trade names or trademarks of any type that appear on the Website are owned by Teatro Real or, given the case, by third parties that have authorised their use. By using or accessing the Website and/or its Contents, no rights are understood to have been transferred to the User in regard to such brands, trade names and/or trademarks, and none of the exploitation rights that exist or could exist in regard to such Contents are understood to have been ceded to the User. Similarly, the Contents are the intellectual property of Teatro Real or, given the case, third parties.

 

Intellectual Property rights are owned by Teatro Real or third parties that have authorised their use. Any exploitation rights of said contents, in particular, the rights of reproduction, distribution, public communication and transformation correspond to them.

 

Unauthorised use of the information contained in the Website, its resale, and the violation of the intellectual or industrial property of Teatro Real will entail the legal liabilities established to this end.

 

Jurisdiction


These general terms and conditions are governed by Spanish Law. The parties agree to be subject to the Courts of the city of Madrid, with express waiver of any other jurisdiction that may correspond to them, to settle any controversy derived from accessing or using the Website.
